"The Publisher" refers to Scoop Publishing (ABN 23 093 452).
"Scoop Publications" refers to any of the following; Scoop Magazine, Scoop Insite, Scoop Annuals (Best Kitchens & Bathrooms, Best Homes, Best Outdoors & Gardens, Best Commercial Designs), Scoop Traveller WA, Scoop Traveller SA, Scoop Traveller NT, Scoop Traveller Vic/Tas, Scoop Traveller NSW/Canberra, Scoop Traveller QLD.
1. General Conditions
1.1. Advertising accepted for publication in Scoop Publications is subject to the conditions set out here and the rules applicable to advertising laid down from time to time by the Media Council of Australia.
1.2. Every advertisement is subject to the Publisher's approval and the Publisher may, at its discretion, refuse to accept an advertisement for publication if it believes the advertisement may infringe the rights of any person or may not comply with all laws and regulations of the States and Territories.
1.3. The Publisher accepts no responsibility or liability in relation to any loss due to the failure of an advertisement to appear according to instructions.
1.4. The positioning or placing of an advertisement within the accepted classification is at the discretion of the Publisher except where specifically instructed and agreed upon by the Publisher.
2. Indemnity & Warranty
1.1. The Advertiser agrees to indemnify and keep indemnified Scoop Publishing in respect of all liabilities, losses, damages, costs or expenses whatsoever in relation to any claim, demand, action, suit or proceeding whatsoever brought by any third party arising out of or in connection with any material published by Scoop Publishing on behalf of the Advertiser.
2.2. The Advertiser warrants to Scoop Publishing that all advertising material and information to be submitted at or on behalf of the Advertiser is such that its publication will not infringe the provision of any law or statute and will not give rise to any claim or right of action whatsoever against Scoop Publishing; whether at common law or statute.
3. Cancellations
3.1. Advertisements cancelled before cancellation deadline will incur no penalty.
3.2. Cancellations after the cancellation deadline but before the order deadline will incur a penalty fee of 25% of the cost of advertising.
3.3. Advertisements cancelled after the order deadline will be liable for the full amount agreed upon.
4. Rates and Credit Terms
4.1. All rates apply for Scoop Publications, published up until June 30 2007 and are subject to change without notice.
4.2. Final payment is due 30 days from invoice date. Interest of 1% per month will be charged on overdue accounts. At such time as the account is placed with a debt collection agency, the client must bear all collection costs.
5. Artwork
5.1. All rates assume that finished artwork is supplied according to mechanical specifications for artwork.
5.2. The Publisher reserves the right to reject any advertisement as a whole. All advertisements are accepted subject to the Publisher`s approval, without prejudice, in every respect with regard to material, layout or otherwise and may be modified or altered at the Publisher`s discretion if the material supplied is not in accordance with the mechanical specifications.
5.3. The Publisher takes no responsibility for incorrect placement of material provided by the Advertiser that is not accompanied by specific material instructions. The cost to the Publisher of making good any such material shall be paid by the Advertiser to the Publisher on demand.
6.4. The Publisher shall not be responsible for any loss or damage consequent to the failure of an advertisement to appear in accordance with the instruction given by the Advertiser.
5.5. All advertising material must be supplied to the Publisher in accordance with the mechanical specifications by the Advertising Deadline. If material is not supplied by the Advertising Deadline, the Publisher reserves the right to repeat the most recent material. Alternatively, the Advertiser or his agent will be charged for the advertising space as contracted and the space will be filled at the Publisher�s discretion.
6. Agency Conditions
6.1. If payment is not made on or before the 15th day of the second month following the on-sale date, no commission will be allowed (10% net commission on space allowed to accredited advertising agencies only).
